- Maybe the fact that "the 1/4 limit imposed by the kernel on the
  argument and environment can be bypassed through the argument and
  environment pointers" needs to be fixed, and needs a CVE too, but it
  all depends on the original intention of the developer(s) who
  implemented this restriction.

(This would help address space exhaustion, and making the stack gap problems (easier) exploitable.)

I believe that 98da7d08850f ("fs/exec.c: account for argv/envp pointers") should be a mitigation to the problem described in the initial comment (embargo is gone so let's make it public). Also https://cve.mitre.org/cgi-bin/cvename.cgi?name=CVE-2017-1000365 describes the problem as

I still not see this CVE or bug mentioned in cve/linux-3.12 for SLES 12 GA or SP1?
