With kde4-konsole-4.1.2-35.2, I observe the following:
1. In the edit profile dialog I uncheck "Show menu bar in new window" and apply the change.  Then I type Ctrl+Shift+M to open a new konsole window, and it shows the menu bar anyway.  
2. In the context menu I uncheck "Show menu bar", and the menu bar is hidden.  Then I type Ctrl+Shift+N to make a new tab, and the new tab shows the menu bar, but in the context menu "Show menu bar" is still unchecked (so I have to click it twice to hide the menu bar again).  And if I type Shift+Right or Shift+Left to switch back to the first tab, now it also shows the menu bar, and in the context menu "Show menu bar" is still unchecked.
